As big a fan as I am of advancements in the tools and equipment we use to improve our homes, I love it when smart, well-executed?but comparatively basic?design is what gets the job done. And done well. This is the case for the superbly nimble, quiet, and powerful Troy-Bilt TB130 walk behind push-mower. No transmission, no cup holder. No faux aerodynamics or laser-guided landscaping. Just plain old smart design and gobs of lawn mowing go-juice. The 3-in-1 TB130 (mulch, side-discharge, rear-bag) starts easily and dependably. The 160cc OHC Honda engine runs extremely smooth and, to my ears, much quieter than other mowers I?ve used. The large rear wheels are nimble while the smaller front wheels are beefy. The entire unit is maneuverable around the various yard obstacles?from playsets to petunia beds?around which I?ve taken it and because it is not laden with added features and bigger engines to power them the TB130 creates a sensible feature unto itself: it?s light and easy to push! When the grass gets away from me for a week or two beyond the normal mowing schedule, the TB130 still manages to leave a smooth cut without much complaint. You can even get the unit serviced (i.e. annual tune-ups which I prefer to do in off-mowing months) at Lowes. Even the wheel height adjustment is simple, effective and easy to use. If you?re looking for a great, get it done mower for your yard, gas-up, the TB130 is good to go.

Murdoch's papers, others condemned in phone-hack report

Senior judge Brian Leveson remarks on the findings of his yearlong inquiry into the phone-hacking scandal that shook up British media.

Updated at 10:35 a.m. ET: LONDON ? Rupert Murdoch?s newspapers and other British media were reckless in the pursuit of sensational stories "almost irrespective of the harm" caused, according to a major report on Britain's?phone-hacking scandal.

The findings of the year-long Leveson Inquiry criticized a ?failure of systems of management and compliance? at Murdoch?s News of the World (NoTW) tabloid, which was closed down as the full extent of their illegal actions became clear.

Lord Justice Leveson said if Murdoch and his son James did not know about the extent of phone-hacking at the paper, then there had been a "determined cover-up" by unidentified staff.


And if they had known then the Murdochs should have done something about it, he said. However, the judge added there was no evidence from which he could "safely infer" that Rupert Murdoch was aware of a wider problem.

The report is being watched by American lawmakers amid concerns that U.S. laws may have been broken.

Leveson did not recommend state regulation of the media ? or censorship in the eyes of some ? as some victims of press intrusion had demanded, but did propose a new self-regulatory body enshrined in law.

The inquiry was set up after it emerged that people working for the News of the World had hacked into messages on a phone belonging to?Milly Dowler, 13, while she was a missing person in 2002. She had been abducted and was murdered.

A string of other examples of phone-hacking and other examples of press intrusion then emerged.

In its report on Britain's phone-hacking scandal, the Leveson Inquiry described a failure of management systems at newspapers owned by Rupert Murdoch and others.

Leveson said it was not just Murdoch?s newspapers that were at fault, adding that?"outrageous" behavior by the press had "wreaked havoc with the lives of innocent people."

?There has been a recklessness in prioritizing sensational stories almost irrespective of the harm that the stories may cause and the rights of those who would be affected (perhaps in a way that can never be remedied),? his report said.

?Too many stories in too many newspapers are the subject of complaints from too many people,? it added.

But Leveson was scathing about the Murdoch empire and the News of the World in particular.?He said there was "a general lack of respect for individual privacy and dignity? at the paper.

And the judge said there had been a ?serious failure of governance? at the News of the World, News Corporation and its U.K. arm News International in dealing with the phone-hacking allegations.

?There was a failure on the part of the management at the NoTW to take appropriate steps to investigate whether there was evidence of wrongdoing,? he said.

Author J.K. Rowling and actress Sienna Miller testified at the Leveson inquiry, addressing the emotional pain they experience after having their privacy invaded by tabloid reporters. NBC's Michelle Kosinski reports.

'Determined cover-up'
Leveson said if Rupert Murdoch and his son James were kept in the dark then ?one or more parts of the management at the NoTW was engaged in a determined cover-up to keep relevant information about potential criminal activity within the organisation from senior management within NI.?

?? if James Murdoch had been the victim of a cover-up, or an attempt to minimise the gravity of the position, then the accountability and governance systems at NI would have to be considered to have broken down in an extremely serious respect,? he added.

Leveson said there was ?no evidence? from which he could ?safely infer that Rupert Murdoch was aware of a wider problem.?

But Leveson noted Rupert Murdoch did not appear to have followed up -- or arranged for his son James to follow up -- on the instructions Murdoch said he gave to Colin Myler, editor of the News of the World from 2007 to 2011, to ?find out what the hell was going on.?

Actor Hugh Grant took a starring role on Monday in a London courtroom, where he testified at a public hearing about alleged phone hacking by British tabloids. NBC's Stephanie Gosk reports.

?If News Corporation management, and in particular Rupert Murdoch, were aware of the allegations, it is obvious that action should have been taken to investigate them,? Leveson said.

The report noted evidence given to the inquiry that News International had been ?obstructive? during an early police investigation into phone-hacking.

?The approach taken by NI is far from what might be expected of a well-run corporation ? An organisational culture that is founded on integrity and honesty would require not only full co-operation with law enforcement, but also a determination to expose behaviour that failed to comply with the law,? the report said.

Leveson said that what was needed was a ?genuinely independent and effective system of self-regulation.?

The current Press Complaints Commission includes members of the media industry, but Leveson said his proposed new body should have no ?serving editors or members of the House of Commons or government.? He also said that the new body should?be recognized in law.

He said he was ?struck by the evidence of journalists who felt they might be put under pressure to do things that were unethical or against the [press standards] code.?

To address this, he said there should be a new whistleblowing hotline and the new board should ?encourage? media firms to include a ?conscience clause? in their employment contracts.

U.S. senator: 'Deplorable conduct'
Senator Jay Rockefeller, chairman of the Senate commerce committee, earlier signaled he would be paying close attention to the findings of the report.

In an emailed statement sent to NBC News before it was released, he called on investigators in the U.K. to hold media companies accountable for their ?deplorable conduct.?

The parents of murdered school girl Milly Dowler told the Leveson Inquiry how her phone had been hacked into when she went missing, giving them false hope that she may still be alive. ITV's Damon Green reports.

Rockefeller said that was "deeply concerned" that media companies "may have violated U.S. laws and injured U.S. citizens."

He said he hoped Leveson?s report and other investigations would hold the media organizations involved ?accountable for their deplorable conduct.?

?While I understand that the main goal of this report is to make policy recommendations, the core of the inquiry remains the illegal and unethical practices of newspapers owned by the News Corporation,? Rockefeller said.

Britain's former Prime Minister Tony Blair admitted he was very close to News International as Prime Minister - but he told the Leveson Inquiry it was a working relationship, not a close one. Testimony was briefly interrupted by a protestor who accused Blair of being a "war criminal." ITN's Tom Bradby reports.?

Former top aide to UK PM David Cameron charged in perjury case

Meanwhile, former News of the World editor Andy Coulson, who was later hired as U.K. Prime Minister David Cameron's chief media adviser, and Rebekah Brooks, the former CEO of News International, appeared in court Thursday to face charges related to allegations of corrupt payments made to public officials, ITV News reported. They were later released on bail.

ASHBURN, Va. (AP) - With all the focus on Robert Griffin III's running ability, it can be easy to overlook the fact that he's having the most accurate passing season by a Washington Redskins quarterback since Sammy Baugh.

Through his first 11 NFL games, Griffin has completed 67.5 percent of his passes, trailing only Alex Smith, Matt Ryan and Peyton Manning among regular starters. The only Redskins QB with a better percentage for an entire season is the legendary Baugh, who hit 70.3 percent in 1945.

Coaches say Griffin's ability to extend a play with his legs gives him more chances to find open receivers - whereas other quarterbacks might have to throw the ball away to avoid a sack.

The Redskins host the New York Giants on Monday night.

RV industry's recovery gains speed in 2012

LOUISVILLE, Ky. (AP) ? The RV industry's recovery from the Great Recession has picked up speed.

Recreational Vehicle makers are churning out higher numbers of travel trailers bound for dealers' lots and, ultimately, campgrounds.

Overall shipments from manufacturers to dealers ? a key measure of consumer demand ? are expected to rise 10 percent in 2012 and could gain another 4.5 percent next year, the Recreation Vehicle Industry Association said Tuesday.

Through September, shipments were up nearly 11 percent from the same period last year, the group said. The higher-than-expected number had dealers, manufacturers and suppliers feeling more optimistic as they gathered this week for an annual industry trade show.

"We made up a lot of ground this year," said Jeffrey Pastore, owner of Hartville RV Center in northeastern Ohio. "We're seeing a lot more buyers walking in the door, and we're seeing those buyers with more money in hand."

Sales at his dealership are up about 18 percent so far this year, and he's predicting another 15 percent gain in 2013. It's a big turnaround from 2009, when sales plunged 40 percent amid the country's worst economic downturn since the Great Depression.

"It was dreadful," said Tom Stinnett, an RV dealer in southern Indiana. "There were a lot of us wondering if we were going to make it."

Shipments to dealers slumped to 165,700 units in 2009, as weak demand and evaporated credit left dealer lots clogged with vehicles and forced the industry to lay off tens of thousands of workers. This year's shipments are expected to be better ? hitting 277,300 units ? although that is still below the 353,400 in 2007.

Jobs are coming back, too. RV manufacturers and suppliers have started hiring, and the industry's workforce has risen to 375,000 from below 250,000 in 2008, according to RVIA. It's still below the 530,000 from 2007.

Driving the industry's gradual comeback have been less-expensive towable RVs attached to pickups or hitched to other vehicles.

Towables, which now account for about 90 percent of the new RV market, cost between $8,000 and $100,000, with an average price of $32,000, according to RVIA. Before the recession hit, towables represented eight out of every 10 new RVs shipped.

By contrast, stand-alone motor homes range in price from $55,000 to $1.5 million for top-of-the-line, bus-like vehicles. The average price is $100,000 for the amenity-filled moving homes.

"It's a given that consumers love to do this, or there would be no market at all because they don't have to have it," Stinnett said. "But they're simply not willing to commit as much money."

KZ RV, based in Shipshewana, Ind., has regained about three-fourths of its pre-recessionary business, but the manufacturer has seen the shift in consumer demand toward towables. Its most popular products cost between $10,000 and $35,000 ? well off its top-of-the-line RVs, which run about $90,000, said Andy Baer, the company's vice president of sales.

"Seven years ago they didn't give a thought to buying a top-of-the-line product, kind of similar to the housing industry," Baer said. "People are more in tuned with what the reality is that they can comfortably afford today."

Ann Arbor, Mich.-based Thetford Corp., which supplies toilets and sinks to RV makers, saw its business plunge by 70 percent during the recession. It survived the downturn because RV owners upgraded existing models, said Executive Vice President Kevin Phillips. Now, the company is having a good year as existing RV owners purchase upgrades and entry-level buyers enter the market, he said.

Winnebago Industries Inc., best known for its premium products, also has adjusted to the new market.

The company, headquartered in Forest City, Iowa, is rolling out towable products again after a decades-long absence from that market.

And Winnebago has stepped up its presence in the market for entry-level motor homes priced in the $60,000 to $70,000 range. Those vehicles offer fewer features and amenities than their pricier counterparts.

"That's where we see a lot of the movement in the industry," said Scott Degnan, the company's vice president of sales.

Winnebago's profits soared in its last fiscal year, which ended Aug. 25. Winnebago earned $45 million over those 12 months, up from $11.8 million in the prior year. Revenue rose 17 percent to $581.7 million.

Researchers synthesize new kind of silk fiber, and use music to fine-tune material's properties

ScienceDaily (Nov. 28, 2012) ? Pound for pound, spider silk is one of the strongest materials known: Research by MIT's Markus Buehler has helped explain that this strength arises from silk's unusual hierarchical arrangement of protein building blocks.

Now Buehler -- together with David Kaplan of Tufts University and Joyce Wong of Boston University -- has synthesized new variants on silk's natural structure, and found a method for making further improvements in the synthetic material.

And an ear for music, it turns out, might be a key to making those structural improvements.

The work stems from a collaboration of civil and environmental engineers, mathematicians, biomedical engineers and musical composers.?

"We're trying to approach making materials in a different way," Buehler explains, "starting from the building blocks" -- in this case, the protein molecules that form the structure of silk. "It's very hard to do this; proteins are very complex."

Other groups have tried to construct such protein-based fibers using a trial-and-error approach, Buehler says. But this team has approached the problem systematically, starting with computer modeling of the underlying structures that give the natural silk its unusual combination of strength, flexibility and stretchiness.

Buehler's previous research has determined that fibers with a particular structure -- highly ordered, layered protein structures alternating with densely packed, tangled clumps of proteins (ABABAB) -- help to give silk its exceptional properties. For this initial attempt at synthesizing a new material, the team chose to look instead at patterns in which one of the structures occurred in triplets (AAAB and BBBA).

Making such structures is no simple task. Kaplan, a chemical and biomedical engineer, modified silk-producing genes to produce these new sequences of proteins. Then Wong, a bioengineer and materials scientist, created a microfluidic device that mimicked the spider's silk-spinning organ, which is called a spinneret.

Even after the detailed computer modeling that went into it, the outcome came as a bit of a surprise, Buehler says. One of the new materials produced very strong protein molecules -- but these did not stick together as a thread. The other produced weaker protein molecules that adhered well and formed a good thread. "This taught us that it's not sufficient to consider the properties of the protein molecules alone," he says. "Rather, [one must] think about how they can combine to form a well-connected network at a larger scale."

The results are reported in a paper published in the journal Nano Today.

The team is now producing several more variants of the material to further improve and test its properties. But one wrinkle in their process may provide a significant advantage in figuring out which materials will be useful and which ones won't -- and perhaps even which might be more advantageous for specific uses. That new and highly unusual wrinkle is music.

The different levels of silk's structure, Buehler says, are analogous to the hierarchical elements that make up a musical composition -- including pitch, range, dynamics and tempo. The team enlisted the help of composer John McDonald, a professor of music at Tufts, and MIT postdoc David Spivak, a mathematician who specializes in a field called category theory. Together, using analytical tools derived from category theory to describe the protein structures, the team figured out how to translate the details of the artificial silk's structure into musical compositions.

The differences were quite distinct: The strong but useless protein molecules translated into music that was aggressive and harsh, Buehler says, while the ones that formed usable fibers sound much softer and more fluid.

Buehler hopes this can be taken a step further, using the musical compositions to predict how well new variations of the material might perform. "We're looking for radically new ways of designing materials," he says.

Combining materials modeling with mathematical and musical tools, Buehler says, could provide a much faster way of designing new biosynthesized materials, replacing the trial-and-error approach that prevails today. Genetically engineering organisms to produce materials is a long, painstaking process, he says, but this work "has taught us a new approach, a fundamental lesson" in combining experiment, theory and simulation to speed up the discovery process.

Materials produced this way -- which can be done under environmentally benign, room-temperature conditions -- could lead to new building blocks for tissue engineering or other uses, Buehler says: scaffolds for replacement organs, skin, blood vessels, or even new materials for use in civil engineering.

Elliott Schwartz, professor emeritus of music at Bowdoin College, says: "For centuries, mathematics, logic and science have provided important models for musical structures, processes, and our understanding of sonic materials. The present research may well lead to one more important chapter in this ongoing story of mutual interaction."

It may be that the complex structures of music can reveal the underlying complex structures of biomaterials found in nature, Buehler says. "There might be an underlying structural expression in music that tells us more about the proteins that make up our bodies. After all, our organs -- including the brain -- are made from these building blocks, and humans' expression of music may inadvertently include more information that we are aware of."

"Nobody has tapped into this," he says, adding that with the breadth of his multidisciplinary team, "We could do this -- making better bio-inspired materials by using music, and using music to better understand biology."

My daughter, Louise, slept for the first three weeks of her life. Twenty to 21 hours a day. She slept so much that I actually called the doctor's office, convinced that something was wrong with her, because there was just no way that I finally had two children and it was... actually kind of easy. Then, one night, she came to life like a stormy little thunder cloud. She even lived up to her big sister's reputation for being a terrifyingly demanding baby. She cried a lot. Inconsolably. For hours.

Doctors don't really know why some babies are colicky. They think maybe it's related to digestion or over-stimulation. Some doctors blame anxiety in the mother. All they can really tell you with any degree of certainty is that they'll grow out of it by the time they're 3 or 4 months old. Both of my babies screamed for at least three hours every evening, red-faced and tightened up with little muscled fists. We would sit at the table together for dinner in the fading daylight, pretending to enjoy ourselves for the sake of my fragile domestic sanity, my husband exclaiming that the veggie dogs I'd microwaved were delicious, while the baby screamed and screamed in the carrier strapped to my chest.

They're wondrous, newborns. Doctors don't know for sure why babies cry like that, but I'm pretty sure I do.

I watched my grandmother dying last winter. She had breast cancer that eventually settled into her brain, and she slowly became less and less like a person inhabiting a body. At first, she spent almost all of her time here, with us, being alive and full of anxieties, and over the course of a few months, she slowly existed more and more in the place people go when they die. At the end of her life, she slept almost all day; long stretches of sleeping, punctuated by waking moments of serenity where she would stare through the world with faraway eyes. She talked to people who were gone. Sometimes she woke up in a panic, unsure of where she was. She would cry like a child, calling out for someone to hold her hand. She craved simple things, like ice cream and sunlight on the back porch steps. Watching someone die made me a better mommy to my second newborn daughter.

At the end of her life, my grandmother slept for 20 of every 24 hours. She made expressions in her sleep. The whisper of her eyebrows would raise and her toothless mouth formed silent words. Her hair was gone. Her head was covered in a fine, soft fuzz. She was always cold. She marveled over the heat of another person, clutching at their hands and saying, "You're so warm!" I watched as she plucked at the fabric of her white bedding with aimless fingers. I saw how she looked through me unless I startled her back into being. If I wanted her to really see me, I had to yell her name, "Grace!" She would blink into existence for a moment, register my face slowly and smile, then drift back into the place between worlds.

I understand that both of my daughters knew what it was like to be dead when they were born. Over the first few weeks of their lives, they plucked and stretched and peered their way into themselves, into their places in the world. They took their time coming away from that other place. ?This research shows that we must seriously consider both the near-term ramifications of the fiscal cliff and the long-term implications of expanding government debt,? said Michael W. McCormick, GBTA executive director and COO. ?Either way, the fiscal cliff is a wake-up call for leaders looking to craft smart economic policy going forward.?

BRUSSELS (AP) ? Finance ministers from the 17 European Union countries that use the euro are trying to hammer out a deal Monday in Brussels on the next installment of bailout money for struggling Greece.

The ministers have failed twice in the last two weeks to reach an agreement to release some ?44 billion ($56.8 billion) for the cash-strapped country.

Greece is living on borrowed time ? it still owes money it was supposed to repay last week.

On his way into the meeting, Olli Rehn, the EU's top financial official, said it was important for the ministers and the International Monetary Fund to agree on a deal. Distributing the next batch of loans was essential, he said, "in order to end the uncertainty that's still hanging over Greece. It's important for Greece, important for Europe."

"I want to encourage all the euro area member states and the IMF to go the last mile to find an agreement ? in fact to go the last centimeter, because we are so close," Rehn said. "Greece has delivered. Now it is the delivery time for the eurogroup and the IMF."

The so-called troika of the European Central Bank, IMF and the European Commission, which is the 27-country EU's executive arm, have twice agreed to bail out Greece, pledging a total of ?240 billion in rescue loans. In return for its bailout loans, Greece has had to impose several rounds of austerity measures and submit its economy to scrutiny.

Greece's fortunes are inextricably tied to the rest of the eurozone. Without the bailout funds that have been keeping it afloat since May 2010, the country would default and could end up having to leave the eurozone. This could have a domino effect on other financially troubled eurozone nations.

Greek Finance Minister Yannis Stournaras said action needed to be taken.

"Greece has fully delivered its part to the agreement, so we expect our partners to deliver their part, too, and I am sure we will find a mutually beneficial solution," he said.

But the prospect of yet another batch of bailout money left some ordinary Greeks unimpressed.

"Did we get anything from any of the previous loan installments?" asked Eleni Myronidou, a retiree in Athens. "Did the people get anything? The banks did. It's all about the banks. Nothing for the people. They should be ashamed of themselves. They should be ashamed."

Greece is unlikely to complete its program of budget cuts and reforms by 2014. For this reason, it is likely to be given an additional two years by the troika. But that extension will cost several billion more, and it is disagreements over how to fund this that have stopped Greece from getting its money.

Several proposals have been floated as ways to plug the financial hole. These include reducing the interest rate Greece pays on its loans from euro partners, lenders such as the ECB giving up interest or profit on their loans, a debt buyback that would reduce the country's burden in the long term, and debt forgiveness by some other countries in the eurozone.

But most of those solutions involved dipping once again into the pockets of taxpayers ? something that has become increasingly unpalatable politically.

"There have been disputes in recent weeks among the members of the troika," said Craig Erlam, an analyst at Alpari. "However these are expected to be resolved today, meaning Greece will finally receive the next bailout payment. If not, Greece could run out of money in the coming days, the consequences of which could be disastrous for the eurozone."

The troika partners disagree on whether Greece should be given an extra two years, to 2022, to bring its debt down to 120 percent of gross domestic product from the 176 percent forecast for this year. The IMF has resisted such an extension.

The ministers hope to reach a political agreement Monday. That agreement will have to be submitted to national parliaments in some countries. After that, the finance ministers plan to hold another meeting, either in person or by telephone, to give final approval to the disbursement.

German Finance Minister Wolfgang Schaeuble ruled out a public-sector debt write-off, and said other eurozone member countries had taken the same position.

But he said he was optimistic about the talks.

"We will find a solution, I am very confident of that," Schaeuble said.

Bangladesh's garment industry employs 4 million people, 3 million of them women, at some 4,500 factories, says Siddiqur Rahman, acting president of the Bangladesh Garment Manufacturers and Exporters Association (BGMEA). The 2006 Bangladesh Labor Law and the Factories Rules of 1979 would be strong laws if they were applied effectively, says Babul Akhter, president of the Bangladesh Garment and Industrial Workers? Federation, a national trade union federation. Both legal frameworks stress the welfare of workers and settlement of disputes between workers and employers. To date, however, none of the factory fires have had a conclusive investigation, nor has anyone been found responsible.

The Factories Rules require specific provisions for escape in the event of an emergency for factory buildings housing explosive or highly flammable materials: "The means of escape shall include at least two separate and substantial stairways permanently constructed either inside or outside the building and which afford direct and unimpeded access to ground level."

Garment factories have had problems since the early 1990s, when the industry was developing. ?Unfortunately, the owners pay no heed to ensure the minimum safety standards inside the buildings,? says Mr. Selim.

That's because the rules are easy to get around, say observers.

Though international buyers often require factories meet the safety and requirements, often the auditors representing them are not well trained, says Selim, enticing owners to save money by only appearing to adhere to standards.

When the industry was just starting, there was a government push to expand, says an insider within the fire service. That push encouraged looking the other way when it came to safety inspections, at least temporarily. ?In the initial stage, for the expansion of industry, the fire service issued warehouse or workshop license to buildings, overlooking many compliance issues,? says the insider.

Many activists and workers blame the factory owners.

The gates are padlocked primarily for two reasons, says Mr. Akhter, ?so that workers do not leave the workplace or raw materials and goods do not get stolen.?

But he says that if cameras were installed and security guards present, they wouldn?t have to lock the doors.

?It comes as a moral responsibility for the owners to ensure the fire safety standards," he says. "Locking the exits at the stairways means that the owners prioritize their goods and raw materials over the lives of the workers,? he says.

Manslaughter charges generally require a finding of gross negligence; seaman's manslaughter does not.

The U.S. Court of Appeals for the 5th Circuit affirmed that distinction in a 2005 case, U.S. v. O'Keefe, which could be key precedent in the BP case. The O'Keefe case resulted in the seaman's manslaughter conviction of a tugboat captain whose wife drowned in the Mississippi River after the vessel capsized. At trial, the government introduced testimony indicating that the captain had ingested cocaine on the day of the accident. Prior to deliberations, the captain's lawyer asked that the jury be instructed that the government must show the accident was a result of "gross negligence," defined as "wanton or reckless disregard for human life."

U.S. District Judge Helen Berrigan in New Orleans disagreed, ruling that the statute requires only a finding of negligence, which she defined as an "omission to perform some duty" or a "violation of some rule or standard of care, which is made to govern and control one in the discharge of some duty." The 5th Circuit upheld her ruling and the captain's conviction.

But the 5th Circuit decision left unanswered the question of whether the government can assert seaman's manslaughter against Kaluza and Vidrine at all. The two are accused of failing to alert engineers onshore that BP's Macondo well was unstable and of accepting "illogical" explanations from members of the rig crew for the warning signs. In the indictment, prosecutors allege the two men violated the seaman's manslaughter statute by engaging in "negligence" and "inattention" to their duties.

Here's what the seaman's manslaughter statute says: "Every captain, engineer, pilot or other person employed on any steamboat or vessel, by whose misconduct, negligence or inattention to his duties on such vessel the life of any person is destroyed ... shall be fined under this title or imprisoned not more than ten years, or both."

Vidrine and Kaluza were not captains or engineers of the Deepwater Horizon. The two have been described by investigators, including those who wrote the "Chief Counsel's Report" on the Deepwater disaster, as "well site leaders." According to the report, well site leaders served as BP's "eyes and ears, and made important decisions regarding the course of drilling operations." As the litigation against Vidrine and Kaluza progresses, a judge may have to decide whether "well site leaders" should fall within the "other person" category covered by the seaman's manslaughter statute.

A search of the database of legal research service Westlaw shows the statute has rarely been used in the last decade, and when it has, it has mostly been against defendants who were responsible for navigating a vessel. In the case of the convicted tugboat captain, neither the trial judge nor the 5th Circuit addressed who is covered under the statute, but Judge Berrigan emphasized the statute's purpose of holding responsible those in charge of navigation.

"In light of the unique dangers of maritime travel, the vulnerability of passengers on board such vessels and the voluntary nature of employment or ownership, it is reasonable to impose on such crews a heightened degree of care with the parallel lower threshold for criminal liability," she wrote.

It may be a long shot for Vidrine and Kaluza to argue that the seaman's manslaughter statute does not apply to them, but it's probably one worth taking. Vidrine counsel Robert Habans of Habans & Carriere and Kaluza lawyer Shaun Clarke of Gerger & Clarke both declined to comment. They have previously said their clients are innocent and have been unfairly targeted by the government.

Author Bryce Courtenay dies 2 weeks after publishing final novel

CANBERRA (Reuters) - Best-selling Australian author Bryce Courtenay, who wrote about the struggles of life in Australia and South Africa, died at his home in Canberra, his publisher said on Friday, just two weeks after his latest novel was published.

His death late on Thursday came less than three months after he told fans he had stomach cancer. He was 79.

"We'd like to thank all of Bryce's family and friends and all of his fans around the world for their love and support for me and his family as he wrote the final chapter of his extraordinary life," his wife Christine Courtenay said in a joint statement with publisher Penguin Books.

Known for his dedication to work and prolific output, often writing for 12 hours a day, Courtenay sold more than 20 million books. He turned to writing in the late 1980s after a 30-year career in advertising.

His first novel, "The Power of One", the story of a child growing up under apartheid in South Africa, was an instant hit, selling more than 8 million copies and later made into a movie.

Born into poverty in South Africa, Courtenay studied journalism in London and then settled in Australia with his first wife, Benita, in 1958.

In 1993, he turned to non-fiction with "April Fool's Day", a personal account of his son Damon's death after he contracted the AIDS virus from a routine blood transfusion.

He usually wrote a book each year. His final novel, "Jack of Diamonds", was published in early November, and featured a farewell from Courtenay to his readers.

"It's been a privilege to write for you and to have you accept me as a storyteller in your lives. Now, as my story draws to an end, may I say only, 'Thank you. You have been simply wonderful'."

Courtenay is survived by his wife Christine, and two sons from his first marriage.
